Terms of Service

Welcome to OrbitEOS. These Terms of Service ("Terms") govern your use of the OrbitEOS Service. By creating an account or using the Service, you agree to these Terms.
1. The Service
OrbitEOS provides software to monitor and control electrical assets — solar inverters, batteries, EV chargers, meters — across one or many sites. The Service is provided as a managed cloud platform, accessible via web browser and mobile apps.
2. Your account
- You must be at least 16 years old to create an account.
- You're responsible for keeping your sign-in credentials safe and for all activity under your account.
- Notify us immediately if you suspect unauthorised access at hello@orbiteos.cloud.
3. Acceptable use
Don't use the Service to:
- Break the law, infringe someone's rights, or harm anyone.
- Probe, scan, or test the vulnerability of the Service without our written permission.
- Disrupt the Service, evade rate limits, or scrape content at volumes that interfere with other users.
- Reverse-engineer or copy the Service to build a competing product.
- Resell access to the Service without a written reseller agreement.
4. Your data
You own the data you put into the Service. We process it as your data processor under our Privacy Policy. We do not sell your data, and we do not use it to train external machine-learning models.
5. Control commands and energy systems
The Service can issue control commands to the energy assets you've connected (for example, charging a battery from the grid, or curtailing solar export). You are responsible for ensuring those commands are safe for your specific equipment and environment, and for complying with any local grid codes, utility rules, or warranty terms. We recommend testing automation rules in a non-production setting first.
6. Pricing and billing
Pricing is shown on the marketing site at the time you sign up. Paid plans are billed monthly or annually as you choose. You can cancel at any time; we'll retain your data for 30 days after cancellation, after which it is deleted.
7. Service availability
We aim for high availability but cannot guarantee the Service will always be available without interruption. We may perform maintenance, update components, or temporarily disable features. We'll give advance notice of planned downtime where reasonably possible.
8. Warranties & liability
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Our total liability for any claim arising out of or relating to the Service is limited to the fees you paid us in the 12 months before the claim arose. Neither party is liable for indirect, consequential, or punitive damages.
Nothing in these Terms limits liability that cannot be limited under applicable law (e.g. liability for gross negligence or wilful misconduct).
9. Termination
You may close your account at any time. We may suspend or terminate access if you materially breach these Terms, fail to pay fees, or use the Service in a way that puts other users at risk. We'll give you a chance to cure the breach where reasonably possible.
10. Changes to these terms
We may update these Terms from time to time. If a change is material, we'll notify you by email at least 14 days before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the Netherlands. Any dispute will be resolved by the competent courts in the Netherlands, unless mandatory consumer-protection law in your country of residence requires otherwise.
